The Michigan Civil Rights Commission is investigating whether the state’s civil rights laws provide protection for transgender and nonbinary young individuals. In a unanimous vote, the commission has requested a legal opinion on whether the Elliot-Larsen Civil Rights Act safeguards these youth from discrimination based on their gender identity and sexual orientation. Luke Londo, a commission member, emphasized the need for clarity in the law, particularly regarding the use of preferred pronouns and bathrooms for transgender students. The commission’s aim is to ensure that the rights of young people in the state are adequately protected. Earlier this year, Governor Gretchen Whitmer signed legislation that enshrined LGBTQ protections into the state’s civil rights law, which currently prohibits discrimination in various areas, including employment, housing, public accommodations, and education based on several characteristics, including sexual orientation and gender identity.
